Terms of Service

Welcome to clap ("clap", "we", "us"). These Terms of Service ("Terms") govern your access to and use of the clap website at clap.so and related services (collectively, the "Service").
The Service is operated by the individual who runs clap (not a registered company at this time). In these Terms, "we" and "us" mean that operator acting in a personal capacity.
By accessing or using the Service, creating an account, or placing an order, you agree to these Terms. If you do not agree, do not use the Service.
Note. These Terms describe how clap works today. They are plain-language guidance, not legal advice. When you form a business entity, have a lawyer update these Terms for your company name, state, and tax status.
1. Who we are and how the Service works
clap is an online marketplace that lets you browse products offered by independent sellers ("Sellers"), build a cart, pay through our checkout, and choose pickup or local delivery at checkout.
We facilitate discovery, ordering, payment processing, and coordination of fulfillment. Unless we clearly state otherwise on a product page, Sellers are responsible for the products they list (including descriptions, quality, compliance, and lawful sale). We are not the manufacturer of Seller products.
2. Eligibility and accounts
You must be able to form a binding contract in your jurisdiction to use the Service. The Service is intended for users 18 years of age or older.
When you create an account, you agree to provide accurate, current information and to keep it updated. You are responsible for activity under your account and for safeguarding access to the email or sign-in methods you use (including magic links). Notify us promptly at help@clap.so if you suspect unauthorized access.
We may suspend or terminate accounts that violate these Terms or that we reasonably believe are fraudulent or abusive.
3. Orders, pricing, and payment
3.1 Placing an order
When you place an order, you make an offer to purchase the items in your cart at the prices shown, plus applicable taxes, delivery fees (if any), and other charges displayed at checkout. We or a Seller may accept, decline, or cancel an order (for example, due to errors, availability, limits, fraud prevention, or operational constraints).
Order acceptance occurs when payment is successfully authorized and we confirm the order (including via order confirmation email). Until then, we may cancel without charge.
3.2 Payment and fees (itemized like Etsy)
Before you pay, we show an itemized breakdown on your cart:
- Subtotal — the products in your cart
- Pickup or Delivery — pickup is free; delivery is $4.99 when your subtotal is under $50 and free at $50 or above (as shown on your cart)
- Processing fee — a separate line that covers card and payment-network costs
- Total — what Stripe charges when you complete checkout
Payments are processed by Stripe. You authorize us and Stripe to charge your selected payment method for the total shown on the cart and on Stripe Checkout. We do not store full payment card numbers on our servers.
The processing fee is calculated so that, after Stripe’s estimated US card fees (currently 2.9% + $0.30 on the charge), we receive the subtotal and delivery amounts we quoted. It is not a return or discount on products; it is a pass-through for payment costs, shown upfront for transparency (the same approach many marketplaces use instead of hiding fees in list prices).
The delivery fee (if any) and the processing fee are collected when you place your order and are not refundable (see Section 5.4), even if we cancel delivery, partially fulfill your order, or refund products. International or corporate cards may incur slightly different network costs; the processing line uses our standard US estimate.
Prices are shown in U.S. dollars unless stated otherwise. Taxes, if any, are calculated or displayed at checkout where applicable.
3.3 Pricing and listing errors
We strive to display accurate prices and product information. If we discover a material error (for example, an obvious typo in price or description), we may cancel the order and refund amounts in line with Sections 5.2–5.5, or contact you for instructions.
4. Pickup, delivery, and fulfillment
4.1 Fulfillment options
At checkout you may choose pickup or delivery when offered for the items and location you selected. Available locations, methods, fees, and time windows are shown in the Service and may change.
Pickup is available only at the pickup locations we list in the Service.
Delivery is available only within our current delivery region: the San Francisco Bay Area, California (the "Delivery Region"). We may refine the exact boundaries over time; what matters is whether your address is inside the region we can serve when your order is reviewed.
You are responsible for providing a complete, accurate delivery address. If you choose delivery and the address is outside the Delivery Region (or we otherwise cannot serve that address), we may cancel the order (or the delivery portion) and contact you at the email on your account. Pickup may still be available if offered for your order.
4.2 Scheduled windows
Pickup and delivery are organized around scheduled time windows shown at checkout (for example, a Saturday slot). Windows are estimates, not guarantees. Delays may occur due to weather, traffic, Seller operations, or other factors outside our control.
You are responsible for being available during the chosen window (pickup) or for receiving delivery at the provided address.
4.3 Partial fulfillment
Orders may include items from one or more Sellers. Sellers may fulfill only part of your order when items are unavailable, damaged, or cannot be supplied as ordered.
If we or a Seller partially fulfill your order, we will refund the product subtotal for line items that are not fulfilled (to your original payment method, or as described in your order confirmation or a follow-up email). Refund timing depends on your bank or card issuer; typically 5–10 business days after we initiate the refund.
Delivery fees, payment processing fees, and taxes are not refunded on partial fulfillment (see Section 5.4). Partial fulfillment does not entitle you to keep unfulfilled items at the checkout price, and it does not change our no-returns policy in Section 5 for items you did receive.
4.4 Order cancellation by clap or Sellers
We or a Seller may cancel an order (or remaining unfulfilled portion) before handover — including when a delivery address is outside the Delivery Region, when items are unavailable, or for operational or fraud-prevention reasons.
If we cancel after you have been charged, we will refund eligible product subtotals for canceled or unfulfilled line items as described in Sections 4.3 and 5. Non-refundable fees still apply (Section 5.4).
You may contact us at help@clap.so to request cancellation before fulfillment begins; we will try to accommodate requests but cannot guarantee cancellation once preparation has started — especially for specialty or made-to-order items (Section 5.5).
5. Returns and refunds
5.1 No returns
All sales are final. We do not offer returns, exchanges, or refunds for change-of-mind, buyer's remorse, or items you received in accordance with your order except as expressly stated in these Terms.
5.2 When refunds may still apply
Without limiting Section 4, you may receive a refund of eligible product subtotals when:
- a product line item is not fulfilled (including partial fulfillment),
- we or a Seller cancel standard (non-specialty) product lines before you receive them,
- we determine a duplicate charge or payment error occurred, or
- we are required by law to provide a remedy.
Refunds are issued to the original payment method unless we agree otherwise in writing. Refund amounts follow Section 5.4 (non-refundable fees) and Section 5.5 (specialty and made-to-order items).
5.3 Problems with received items
If you believe an item you received is incorrect, damaged, or unsafe, contact us promptly at help@clap.so with your order number and details (including photos where helpful). We will work with the Seller to review the issue. Any goodwill adjustment is discretionary, subject to Sections 5.4 and 5.5, and does not create an ongoing return program.
5.4 Non-refundable fees
For shoppers: if you receive a refund on an order, it applies to products only. You will not get back the delivery fee or the processing fee you paid at checkout.
The following charges are never refunded, including when an order is canceled, partially fulfilled, or delivery cannot be completed, because the cost is incurred at or before order placement:
- Processing fee — the separate line on your cart and receipt, collected via Stripe when you place the order,
- Delivery fee — if charged for your order, and
- any taxes calculated on non-refunded amounts.
Only product subtotals for items that were not fulfilled or were canceled under these Terms are eligible for refund, unless we are required by law to refund more.
5.5 Specialty and made-to-order products
Some products are specialty items or made to order (prepared, sourced, or customized only after you buy). These are identified on the product page or in the listing (for example, "made to order," "special order," or similar wording).
Specialty and made-to-order products are not refundable once the order is placed, except where required by law. They are excluded from partial-fulfillment refunds in Section 4.3. If you cancel or change your mind, we are not obligated to refund those items or any fees tied to the order.
6. Product information, food, and allergies
Product descriptions, images, ingredients, allergens, and origin information are provided by Sellers or sourced from Seller data. We do not guarantee that descriptions are complete, current, or suitable for your dietary needs.
If you have allergies or dietary restrictions, verify ingredients and labels at pickup or on delivery before consuming. Consumption of food products is at your own risk.
7. Prohibited conduct
You agree not to:
- violate any applicable law or third-party rights,
- provide false or misleading account or order information,
- interfere with the security or operation of the Service,
- scrape, reverse engineer, or misuse the Service except as permitted by law,
- place orders for resale or fraud, or abuse promotions or refunds, or
- harass Sellers, couriers, or anyone involved in operating the Service.
8. Intellectual property
The Service, including its design, branding, software, and content we create, is owned by the operator of clap and protected by intellectual property laws. Seller names, logos, and product content belong to their respective owners.
You receive a limited, non-exclusive license to use the Service for personal, non-commercial shopping in accordance with these Terms.
9. Disclaimers
THE SERVICE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", TO THE FULLEST EXTENT PERMITTED BY LAW. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, THAT DEFECTS WILL BE CORRECTED, OR THAT PRODUCTS WILL MEET YOUR EXPECTATIONS.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR OF CLAP WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE OR ANY ORDER.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR AN ORDER IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE ORDER GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE EVENT OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the minimum permitted by law.
11. Indemnity
You agree to indemnify and hold harmless the operator of clap from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or third-party rights.
12. Disputes and governing law
These Terms are governed by the laws of the United States, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your home state apply.
Before filing a claim, you agree to contact us at help@clap.so and allow 30 days to try to resolve the dispute informally.
If you later register a business entity, we may update this section to name that entity and its home state.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. If changes are material, we will provide notice through the Service or by email where appropriate. Continued use after the effective date constitutes acceptance of the updated Terms.
